Brevra Terms of Use
Last updated and effective: October 22, 2026
These Terms govern your use of the Brevra app, its Apple Watch app, and the related website pages and services ("Brevra", "we", "us"). Brevra is operated by Ronggang Cui, an independent developer based in Alberta, Canada. By creating an account or using Brevra you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Brevra.
Please read section 1 carefully. It explains the risks of exercise, contains an assumption of risk and a release of claims, and section 12 limits our liability. If you live in the United States, section 17 requires disputes to be resolved by individual arbitration and waives class actions and jury trials, unless you opt out. Some of these terms may not apply to you depending on where you live; where that is the case, we say so.
1. Health and safety — please read
- Not medical advice. Brevra is a training log and general fitness information tool. Nothing in the app — including exercise instructions, form cues, workout and program suggestions, starting weights, strength estimates, records, summaries, heart-rate, intensity or calorie figures — is medical, health, nutritional or professional coaching advice, and using Brevra does not create a doctor–patient, trainer–client or any other professional relationship.
- Suggestions are general. Programs, routines, starting weights and progressions are produced by rules from the answers you give and the training you log. No professional has assessed you, your health or your technique. You decide what to do, how much to lift and when to stop.
- Consult a professional first. Talk to a physician before starting or changing an exercise program, especially if you have or may have a heart condition, high blood pressure, diabetes, a joint, back or other injury, are pregnant or recently gave birth, take medication, are over 40 and have been inactive, or have any other medical condition.
- Stop if something feels wrong. Stop exercising immediately and seek medical help if you feel chest pain or pressure, dizziness, faintness, unusual shortness of breath, or sharp or unusual pain. In an emergency, call 911 or your local emergency number.
- Train safely. You are responsible for choosing loads and exercises within your ability, using proper technique, inspecting and using equipment correctly, using a spotter or safety equipment where appropriate, and following the rules of your gym.
- Assumption of risk. Strength training and other physical activity carry inherent risks, including muscle strain, serious injury and, rarely, death. You participate voluntarily and, to the fullest extent permitted by law, you assume all of these risks.
- Quebec residents: the release that follows does not apply to you to the extent it is prohibited by the Civil Code of Québec or the Consumer Protection Act (Québec), which do not allow us to exclude or limit liability for bodily or moral injury, or for the consequences of our own acts. RELEASE OF CLAIMS. To the fullest extent permitted by the law that applies to you, you release Brevra and its operator from any claim for personal injury, illness, death or property damage arising from exercise or other physical activity you undertake while or after using Brevra, including a claim based on our ordinary negligence. This release does not cover gross negligence, intentional misconduct or fraud, or any liability that the law does not allow to be released.
2. Estimates; not a medical device
Volume, records, strength estimates, intensity, calorie and similar figures are estimates calculated from what you log and from data provided by Apple Health or other devices, which may be incomplete or inaccurate. Brevra is intended for general fitness and wellness only. It is not a medical device, and it is not intended to diagnose, treat, cure, monitor or prevent any disease or condition. Exercise instructions are general and may not suit your body, ability or circumstances.
3. Eligibility and availability
You must be at least 18 years old, and an adult where you live, to create an account or use Brevra. By using Brevra you confirm that you meet this requirement. If we learn that an account belongs to someone under 18, we may close it and delete its data.
Brevra is offered only to people in the United States and Canada. You confirm that you are not located in a country that is subject to a United States or Canadian government embargo, and that you are not on any United States or Canadian list of prohibited or restricted parties.
4. Your licence to use Brevra
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the Brevra app on Apple devices you own or control, and to use the service, for your own non-commercial training. The licence is subject to these Terms and the App Store rules, and ends if these Terms end.
5. Ownership and feedback
Brevra — the app, its design, code, the Brevra name and logo, the exercise library (exercise names, descriptions, "how to" steps, form cues and common mistakes), the ready-made routines and programs, and every other piece of content we provide — belongs to us or our licensors and is protected by copyright, trademark and other laws. Apart from the licence above, these Terms give you no rights in it. In particular you may not copy, sell, rent, publish, redistribute, scrape or bulk-download that content, use it to build a competing exercise database or app, or remove any notices from it.
If you send us ideas, suggestions or other feedback, we may use them freely, without any obligation to you.
6. Your account and content
You sign in with Apple or Google and are responsible for everything done on your account. Keep your Apple and Google credentials safe and tell us if you think your account has been misused. The training data you log — workouts, routines, sets, notes and body stats — remains yours. You give us permission to store, process, back up and sync it, and to calculate summaries from it, to provide and improve the service as described in the Privacy Policy. You are responsible for what you put in free-text fields such as notes and routine names: don't enter other people's personal information or anything unlawful, and we may remove content that breaks these Terms. You can export your data (CSV / JSON) and delete your account and data at any time in the app.
7. Subscriptions and payments
Brevra's core logging is free. Some features may be offered as a paid subscription ("Brevra Pro"), bought as an in-app purchase through Apple.
- Price and renewal. The price, billing period and any applicable taxes are shown in the App Store before you buy, in your local currency. A subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. You manage and cancel it in your Apple ID subscription settings, not in Brevra. Cancelling takes effect at the end of the current period.
- Free trials. If a free trial is offered, the App Store shows its length and the price that follows before you start it. It converts to a paid subscription at the end of the trial unless you cancel before then. Any unused trial is forfeited when you buy a subscription.
- Payment and refunds. Apple collects payment under its own terms and we never see your payment details. Refund requests are made to Apple through the App Store; we cannot issue refunds ourselves. This does not limit any right to cancel or to a refund that the consumer protection law where you live gives you.
- Changes. If we raise the price, Apple will tell you in advance and, where required, ask for your consent before the new price applies. We may change what Brevra Pro includes.
- Deleting your account does not cancel a subscription. Cancel it in your Apple ID settings first.
8. Acceptable use
Don't misuse Brevra. In particular, don't: try to access other users' accounts or data; interfere with, overload or disrupt the service or its servers; bypass any security or rate-limiting measure; access the service by automated means or through anything other than the Brevra app, except as we allow; reverse engineer, decompile or copy the app except where the law expressly allows it; frame, mirror or resell the service; or use it for anything unlawful or that infringes anyone else's rights.
9. Devices, connectivity and changes to the service
You need a compatible iPhone (and an Apple Watch, if you use the watch app), an Apple or Google account, and an internet connection to sign in and to sync. You are responsible for your devices, your connection and any data charges, and you must follow the terms of your wireless carrier and other third parties when you use Brevra. Brevra works offline after sign-in and syncs when online. When the same data is edited on two devices, the most recent edit wins. Although we back up your data, we are not a storage service of record, so export anything important. We may change, add or remove features and update the exercise and training libraries at any time. Features marked as beta or test may change or be removed. We may suspend or stop providing Brevra, in whole or in part, at any time. Where practical, we will give you notice so you can export your data.
10. Third-party services
Brevra works with services we don't control, such as Sign in with Apple, Google Sign-In, Apple Health and Apple Watch. Their own terms apply to your use of them, and we are not responsible for their availability or for the accuracy of data they provide.
11. Disclaimer of warranties
Quebec residents: the following section does not apply to you to the extent it excludes or limits the legal warranties provided by the Consumer Protection Act (Québec) and the Civil Code of Québec.
To the fullest extent permitted by law, Brevra is provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Brevra will be uninterrupted, error-free or secure, or that data will never be lost. Some provinces and states do not allow implied warranties or conditions to be excluded; where that is the case, they are limited to the shortest period the law allows.
12. Limitation of liability
Quebec residents: the following section does not apply to you to the extent the Consumer Protection Act (Québec) or the Civil Code of Québec prohibits it, including any limit on liability for bodily or moral injury or for the consequences of our own acts.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, for lost data or profits, or for any personal injury, illness or property damage arising from exercise or other activity you undertake while or after using Brevra, or from your reliance on any content or figure in the app. Our total liability for all claims relating to Brevra is limited to the greater of the amount you paid for Brevra in the 12 months before the claim and 50 Canadian dollars. These limits do not apply to liability for gross negligence, intentional misconduct or fraud, or to any liability the law does not allow to be limited.
13. Indemnity
Quebec residents: the following section does not apply to you to the extent it is inconsistent with the Consumer Protection Act (Québec).
To the extent permitted by law, you agree to indemnify and hold us harmless against claims by third parties, and related losses and costs (including reasonable legal fees), arising from your breach of these Terms, the content you add, your training or other activities, or your misuse of Brevra.
14. Your statutory rights
Nothing in these Terms excludes or limits any right or remedy that cannot be excluded or limited under the law that applies to you, including mandatory consumer protection rights in your province or state, or liability for death or personal injury caused by negligence, or for fraud, where the law does not allow it to be excluded.
15. Apple App Store
If you downloaded Brevra from the App Store:
- These Terms are between you and us, not Apple, and we, not Apple, are solely responsible for Brevra and its content.
- Your licence is limited to using Brevra on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We, not Apple, are responsible for any maintenance and support. Apple has no obligation to provide any.
- If Brevra fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Brevra.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Brevra or your possession or use of it, including product liability claims, claims that Brevra fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Brevra or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
Apple's standard Licensed Application End User License Agreement also applies. If it conflicts with these Terms, these Terms apply to the extent the App Store rules allow.
16. Changes to these Terms; termination
Quebec residents: the paragraph that follows does not apply to you. For you, these Terms change only as described in the paragraph after it.
We may change these Terms from time to time. We will post the updated Terms with a new date and, if a change is material, tell you in the app or by email before it takes effect. If you keep using Brevra after a change takes effect, you accept the updated Terms. If you don't agree, stop using Brevra and delete your account. We may also ask you to accept changes to the health and safety terms in the app.
If you live in Quebec, we may change only these parts of these Terms: the health and safety terms (section 1); the description of estimates, features and content (sections 2, 5, 9 and 10); the account and acceptable-use rules (sections 6 and 8); the subscription terms in section 7, for billing periods that start after the change; the notice and contact details (sections 18 and 20); and any term we must change to comply with the law. We will not change the nature of the service, or the price or length of a subscription period you have already paid for. We will tell you in the app or by email at least 30 days before the change takes effect. The notice will set out only the new or changed text, the text as it read before, the date the change takes effect, and your rights described here. If a change increases your obligations or reduces ours, you may refuse it by closing your account, and cancelling any subscription, at no cost or penalty, at any time up to 30 days after the change takes effect.
You can stop using Brevra and delete your account at any time. We may suspend or end your access if we reasonably believe you have breached these Terms, if the law requires it, or if we stop providing Brevra as described in section 9. When these Terms end, your licence ends, and the sections that by their nature should continue (including ownership, disclaimers, limitation of liability, indemnity and disputes) continue to apply.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration terms below. If you are a consumer, you also keep the protection of the mandatory laws of the province or state where you live. If you have a problem with Brevra, please email us first; most issues can be sorted out informally.
If you live outside the United States, either of us may bring an eligible claim in a small-claims court (in Alberta, the Civil Division of the Alberta Court of Justice). Any other dispute must be brought in the courts of the Province of Alberta, and you agree to their jurisdiction, unless the law where you live lets you bring it at home.
If you live in the United States, the following arbitration agreement and class action waiver apply.
- Informal resolution first. Before starting an arbitration or court case, the party with the claim must send the other a written notice describing it (to us, at the email address below), and we will both try in good faith to resolve it for 60 days. Limitation periods are paused during that time.
- Binding individual arbitration. Any dispute arising out of or relating to these Terms or Brevra will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The hearing will take place by video or phone, or in the county where you live. Fees are paid as those rules provide.
- Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may ask a court to stop the misuse of its intellectual property.
- No class actions; no jury. You and we may bring claims only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding, and you and we waive any right to a jury trial. If this waiver is found unenforceable for a claim, that claim will be decided by a court, not an arbitrator.
- Mass filings. If 25 or more similar demands are filed against us by or with the help of the same lawyers or organization, they will be administered under the American Arbitration Association's Mass Arbitration Supplementary Rules, which may resolve them in batches.
- Opting out. You may opt out of this arbitration agreement by emailing us within 30 days after you first accept these Terms, with your name, the email address on your account and a statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.
- Time limit. To the extent the law allows, any claim must be brought within one year after it arises.
18. Notices
We may give you notices in the app, by a message when you open it, or by email to the address on your account. Notices to us go to the email or mailing address in section 20.
19. General
These Terms and the Privacy Policy are the whole agreement between you and us about Brevra. If any part of them is found unenforceable, the rest stays in force. If we don't enforce a term, that isn't a waiver of it. You may not transfer your rights under these Terms to anyone else. We may transfer ours, for example to a successor of the service. We are not responsible for delays or failures caused by events beyond our reasonable control. These Terms create no partnership, agency or employment relationship.
These Terms are available in English and French, and both versions are equally authoritative. You may read them in either language using the link at the top of this page.
